In proceedings that are conducted according to the principle of party submission, only the facts that are submitted by the parties are dealt with in court. The order to take evidence can therefore only contain the facts of an item of evidence that were brought forward by the parties. For this reason, great demands are generally placed on the parties' factual submissions in terms of detail and substantiation.
